Corporate Price Fixing
Linnan & Fallon, LLP, along with 9 other law firms, represented the named class representative in the New York portion of a multi-state class action lawsuit alleging that the world's major vitamin manufacturer's engaged in an illegal price fixing conspiracy. The multi-state settlement agreement, which resolved similar antitrust class actions pending in 23 states, resulted in the major vitamin manufacturer's agreeing to pay more than $187 MILLION DOLLARS. This class action settlement represented the largest indirect purchaser antitrust settlement in history.
Linnan & Fallon, LLP was instrumental in obtaining judicial approval of New York State's portion of the settlement. As a result of this unprecedented class action settlement, selected New York State Not-for-Profit agencies received nearly $19 million to fund programs designed to improve the health and nutrition of New York's citizens. In addition, commercial entities within New York State who indirectly purchased vitamin products for resale, or for incorporation into other products for resale, were entitled to submit claims against a separate $70 MILLION DOLLAR fund.
