Linnan & Fallon, LLP is uniquely qualified to pursue medical malpractice claims. Our distinctive combination of medical and legal experience gives our firm the ability to properly evaluate, prepare and present your case. Jim Linnan has over 30 years of trial experience and has obtained numerous favorable settlements for his clients. When settlement has not been in the client's best interest, he has taken cases to verdict over 100 times. Charlene Fallon, in addition to having medical malpractice litigation experience, has over 18 years of nursing experience and maintains her Registered Nursing license.
Medical Malpractice is nothing more or less than the negligent or careless giving of medical care. If your doctor, nurse, hospital or other health care provider is careless or negligent in giving you care, and that negligence causes you injury, you are entitled to compensation for that injury.
For example, in today's world of modern medicine and advanced screening techniques, failure to diagnose certain types of cancer, such as cancer of the breast or colon, in a timely fashion may be medical malpractice. The earlier the diagnosis, the better the chances for survival. If you or a loved one have been diagnosed with an advanced stage of cancer, you may be the victim of medical malpractice.
Children with severe disabilities, including cerebral palsy, may have incurred injuries during the birth process as a result of medical malpractice. A thorough review of the medical records will determine if negligence by a health care provider was the cause of the birth injuries sustained.
If you or a family member sustain an injury as a result of the carelessness or negligence of others, including health care professionals, you may be entitled to compensation for that injury. For example, an injury caused by an unsafe or hazardous condition, a careless driver or a negligent doctor may entitle you to a substantial monetary award.
In such cases, our office is prepared to immediately evaluate your case to ensure protection of your legal rights to obtain compensation. That compensation may include your medical expenses, your lost wages and an appropriate sum for your pain and suffering or any other personal loss that you may suffer.
In the event the injury causes death, the heirs of the deceased person are entitled to compensation for the loss of the support that person would have provided. In addition, the heirs of the deceased person may also be entitled to recover for the pain and suffering that the person endured prior to his or her death.
Personal injury matters are handled by our firm on a contingent fee basis. This means that there is no legal fee unless our firm is successful in obtaining a financial recovery for you or your family.
Linnan & Fallon, LLP has extensive experience in representing injured persons and recovering for them the full compensation to which they are entitled. We have received substantial jury verdicts and out-of-court settlements in the areas of medical malpractice, construction accidents, motor vehicle accidents and other types of cases
If you have been involved in a motor vehicle accident, your medical bills and lost wages may be reimbursed under the New York State "No-Fault" Law. In addition to the no-fault benefits, if that accident was caused by the careless actions of others and you have sustained a serious injury, you may be entitled to compensation for your pain and suffering.
Our firm takes each case seriously and gives each case personal attention. Your case will be handled by an experienced attorney, not a paralegal. If a full settlement cannot be reached, we will try your case before a jury. We are not an "800" number that deals with quantity, we are experienced, local attorneys that deal in quality.
We have substantial medical and legal experience in all aspects of motor vehicle accidents and in recovering substantial jury verdicts and out-of-court settlements for our clients.
Workplace and Construction Accidents

If your accident and injury were caused by a violation of the Labor Law, or a violation of the Occupational Safety and Health Act, you may be entitled to substantial additional compensation. We can provide a total evaluation of your case and an expert opinion as to any additional compensation to which you may be entitled.
Large corporations often make a variety of decisions which disregard individual's rights and lead to economic and/or physical injury. Frequently, as a result of the limited nature of the individual's claims, it is not feasible to pursue the corporation on an individualized basis. In such situations, the lone consumer is often powerless against the larger corporation. Class action litigation allows many people having similar small claims to collectively seek redress for an injury that has been done to the entire "class".
A class action is a lawsuit brought by one or more individuals, on behalf of themselves and all others who have been injured in a similar manner. Not only does class action litigation allow numerous individuals with similarly small claims to pursue their injuries collectively, but it also deters harmful and damaging behavior by large corporations. By consolidating the voices of individual consumers, class action litigation forces large corporations to recognize and adhere to their responsibility to the public.
Most class actions are handled by Linnan & Fallon, LLP on a contingency basis. This means that there is no legal fee unless the lawsuit results in some relief to the class members. Even in instances where relief is obtained, the lawyers must still seek court approval of their legal fees and expenses incurred during the course of the litigation.
The lawyers at Linnan & Fallon, LLP have extensive experience litigating disputes to protect the rights of individuals and classes of individuals.
