Car Accident
A family was proceeding home on a narrow state highway when they encountered a late spring snowstorm with severely limited visibility. The mother, driver of the car, observed a vehicle approaching her, which appeared to be in her lane of travel. She swerved to the left in an attempt to avoid the oncoming vehicle at approximately the same time the oncoming vehicle corrected its position and returned to its own lane of travel. The vehicles collided causing the death of the mother "driver" and two daughters riding in the back seat. The father, who was a front seat passenger, suffered significant personal injury but survived.
Linnan & Fallon, LLP retained the services of a nationally known accident reconstruction expert and the services of a video recreation expert who, working together, created video depiction of the happening of the accident. Utilizing this video accident reconstruction we were able to negotiate a substantial recovery for the father and the two surviving children of the family, who were not in the car at the time of the accident.
Toxic Chemical Spill
A regional chemical mixing and distribution company over-pressurized a chemical storage tank causing it to split, resulting in 5,000 gallons of sodium hypochlorite suddenly spilling down an alleyway and into a city street. This chemical then mixed with other chemicals in the plant causing a large gas cloud of chlorine and hydrochloric acid gases to be released into the neighborhood. Linnan & Fallon, LLP represented seven individuals who sustained varying degrees of personal injury to their respiratory systems after inhaling these gases. The chemical company admitted that they were at fault relative to their storage procedures and further admitted that it was their fault that the chemicals had been spilled and the gases released into the atmosphere.
The chemical company's attorneys then produced various national experts who gave the opinion that, in view of the limited amount of gases released and the blowing wind on the day of the incident, no one could have been injured by the chemical company's negligence.
The case involving the seven individuals represented by Linnan & Fallon, LLP proceeded to trial, joined with cases pursued by other attorneys representing individuals from the neighborhood. Linnan & Fallon, LLP were lead counsel at the trial. After three weeks of trial, including testimony from nationally known medical and scientific experts relative to the cause of the spill and the effects of the chlorine and hydrochloric acid gases upon the human respiratory system, the seven plaintiffs represented by Linnan & Fallon, LLP settled for a total of $3.2 MILLION DOLLARS.
